It’s a simple question that comes with a convoluted answer.

With medical cannabis currently legal in 38 states and Washington, D.C., some may assume that they can legally bring their medicine across state lines like any other legal drug. However, bringing cannabis to another state – even another medical marijuana state – remains a potential federal crime due to federal prohibition.

In some states, medical marijuana reciprocity allows visiting medical patients to use their out-of-state cards to purchase cannabis like they could at home. But laws vary from one state to the next. So before planning your next trip or a more extended stay, take a moment to understand which states accept out-of-state medical cards.
Ways Out-of-State Visitors Can Get Medical Cannabis

Even if a state has medical marijuana reciprocity, it doesn’t mean visiting patients are guaranteed to have cannabis access. With each state developing its unique laws, reciprocity regulations vary.

States that accept out-of-state medical cards typically do so through one of the following measures (keep scrolling to see which states employ each of these measures):

Reciprocity
Temporary in-state cards for visitors
Adult-use (recreational) sales

In some cases, states have decriminalized possession for patients with valid out-of-state cards, but they aren’t permitted to participate in the marketplace, prohibiting the person from making legal purchases.

For many traveling MMJ patients, a lack of clarity on cannabis laws can make it tempting to ask a local friend to buy for you (or to bring your own cannabis across state lines). Rather than risking criminal penalties using these methods, it may be best to see if the state you’re visiting participates in one of the above methods, or if it has a legal gifting policy where you can obtain cannabis using a few extra steps.

States with Medical Cannabis Programs

As of Feb 2022, the following states have legal medical marijuana programs. That doesn’t necessarily mean they allow out-of-state card holders to purchase cannabis, but it’s the first step.

The following states allow access to cannabidiol (CBD) only with low or no THC:

Georgia (CBD oil with less than 5% THC)
Idaho (CBD oil with less than 0.1% THC)
Indiana (CBD oil with less than 0.3% THC)
Kansas (CBD oil with 5% THC)
Kentucky (CBD oil only)
North Carolina (CBD oil with less than 0.9% THC and at least 5% CBD by weight)
South Carolina (CBD oil with less than 0.9% THC and more than 15% CBD by weight)
Tennessee (CBD oil with less than 0.9% THC)
Texas (CBD oil with no more than 1% THC by weight)
Wisconsin (CBD oil only)
Wyoming (CBD oil only)

(Reciprocity) Medical Cannabis States That Allow Cannabis Sales to Out-of-State MMJ Cardholders

The following states and territories have legalized medical use for their citizens and visiting patients with valid cards from their home states (with some caveats).

Arizona: Limited reciprocity program, requiring visitors to stay for less than 30 days. Additionally, reciprocity candidates must have received their MMJ license for a qualifying condition that is also on Arizona’s list of qualifying conditions. Patients can also use the state’s adult use market.
Delaware: Condition must be on Delaware’s list of approved conditions.
Maine: Conditions must be similar to those listed in Maine’s program. Patients can also use the adult use market.
Michigan: Dispensaries can choose to accept or reject out-of-state cards.
Montana: A patient’s valid cannabis card and state-issued ID are required for purchases.
Nevada: Accepts all out-of-state cards. Adult use is also permitted.
New Hampshire: A visiting patient’s condition must be on New Hampshire’s list of approved medical conditions.
New Jersey: Out-of-state cards are accepted for those visiting for up to six months. Adult use sales began in April 2022.
New Mexico: A recent court ruling allowed reciprocity in the state. Adult use cannabis is also permitted.
Puerto Rico
Washington D.C.

(Temporary In-State Med Card) Medical Cannabis States That Require Out-of-State Patients to Apply for a Temporary Card

The following states don’t recognize out-of-state medical cards, per se. Instead, patients need to apply for a temporary card while visiting. These states are:

Arkansas: Valid with an out-of-state card and the completion of an intake form, costing $50. Temporary cards are valid for 90 days.
Hawaii: Visitors can apply for a temporary card using the state’s medical marijuana program portal. Those with severe or terminal conditions can apply for an expedited process.
Maryland: The state does not allow out-of-state cards, but visitors can register to receive medical cannabis if they are in Maryland for medical treatment.
Oklahoma: Valid state-issued IDs are accepted if a patient completes a Temporary Patient Application Information form. An out-of-state doctor’s recommendation alone is not sufficient to obtain a temporary Oklahoma MMJ card.

Mississippi’s cannabis legalization effort was thrown out in 2021. While the legislature has since passed a more restrictive bill that may allow temporary cards for out-of-state visitors, the regulations have yet to be written.

States with Adult-Use Recreational Cannabis Sales

The following states have legalized adult use regulations, allowing visiting patients aged 21 and over to purchase cannabis:

Mississippi: The State Supreme Court overturned voter-approved cannabis legalization in 2021. New regulations are being written.
Missouri

Utah: Visiting patients with one or more of Utah’s approved qualifying conditions can possess but not purchase medical cannabis while visiting.
Wisconsin
Wyoming
